Introduction

Welcome to PASSTRIKE. These Terms of Service ("Terms") govern your access to and use of the PASSTRIKE website, mobile application, and fitness coaching services (collectively, the "Services").

PASSTRIKE is a fitness coaching brand operated by F&S Active AB, a Swedish limited company registered in Sweden (Org.nr: 559484-3442).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Acceptance of Terms

1.1 Agreement to Terms

By creating an account, joining our waitlist, or using any part of our Services, you agree to these Terms, our Privacy Policy, and any additional terms applicable to specific features.

1.2 Age Requirement

You must be at least 18 years old to use PASSTRIKE. By using our Services, you represent that you are 18 or older.

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use after changes constitutes acceptance.

2. Description of Services

2.1 Services Offered

PASSTRIKE provides:

  • Access to qualified personal trainers
  • Personalized workout programs
  • Nutrition guidance and meal planning
  • Progress tracking and analytics
  • In-app communication with trainers
  • Educational content and exercise libraries

2.2 Pre-Launch Services

During pre-launch phase, we offer waitlist registration. No payments are collected through this platform.

2.3 Service Availability

Services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free service.

3. Account Registration

3.1 Account Creation

To use our Services, you must:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Maintain the security of your account credentials
  • Notify us immediately of unauthorized access

3.2 Account Responsibility

You are responsible for all activity under your account. You agree not to:

  • Share your account credentials
  • Create multiple accounts
  • Impersonate others
  • Use automated systems to access our Services

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Service Status

Passtrike is currently in pre-commercial development. Subscription plans, pricing, and payment terms will be published when the platform launches commercially. No payments are currently collected through this platform.

5. User Conduct

5.1 Acceptable Use

You agree to use PASSTRIKE only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Conduct

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Upload viruses, malware, or malicious code
  • Harass, abuse, or harm others (including trainers)
  • Use Services for commercial purposes without authorization
  • Reverse engineer, decompile, or hack our platform
  • Scrape or data mine our content
  • Create fake accounts or manipulate platform features
  • Share, sell, or distribute your personalized workout plans commercially

5.3 Content You Provide

You retain ownership of content you submit (photos, messages, progress data). By submitting content, you grant us a license to use, store, and process it to provide Services.

You represent that:

  • You own or have rights to submitted content
  • Content does not violate any laws or third-party rights
  • Content is accurate and not misleading

6. Intellectual Property

6.1 PASSTRIKE Ownership

All content, features, and functionality of our Services (including workout programs, nutritional guidance, text, graphics, logos, software) are owned by PASSTRIKE or our licensors and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial use.

6.3 Restrictions

You may not:

  • Copy, modify, or distribute our content
  • Use our content for commercial purposes
  • Remove copyright or proprietary notices
  • Create derivative works

6.4 Trademarks

PASSTRIKE, our logo, and related marks are trademarks of F&S Active AB. You may not use our trademarks without prior written permission.

7. Health and Safety Disclaimers

7.1 Medical Disclaimer

IMPORTANT: PASSTRIKE provides fitness coaching and nutritional guidance, NOT medical advice.

  • Consult a Physician: Before starting any fitness or nutrition program, consult your doctor, especially if you have pre-existing health conditions, injuries, or concerns.
  • Not a Substitute for Medical Care: Our Services do not replace professional medical advice, diagnosis, or treatment.
  • Emergency Situations: In case of medical emergency, call emergency services immediately. Do not rely on PASSTRIKE for urgent medical issues.

7.2 Assumption of Risk

Physical exercise involves inherent risks, including but not limited to injury, disability, or death. By using our Services, you acknowledge and accept these risks.

7.3 Personal Responsibility

You are responsible for:

  • Assessing your own fitness level
  • Exercising within your physical capabilities
  • Using proper form and technique
  • Listening to your body and stopping if you experience pain or discomfort
  • Ensuring a safe training environment

7.4 Trainer Qualifications

Our personal trainers have proper education and experience in fitness and nutrition but are not licensed medical professionals, physical therapists, or registered dietitians. They provide fitness coaching, not medical treatment.

8. Limitation of Liability

8.1 No Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, PASSTRIKE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PASSTRIKE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND TRAINERS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or use
  • Personal injury or death resulting from use of Services
  • Actions of third parties (including trainers)
  • Technical failures or service interruptions

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO PASSTRIKE IN THE 12 MONTHS PRIOR TO THE CLAIM.

8.3 Jurisdictional Limitations

Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless PASSTRIKE, its affiliates, officers, employees, and trainers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Content you submit to our Services
  • Your interaction with trainers or other users

10. Third-Party Services

10.1 Third-Party Links

Our Services may contain links to third-party websites or services. We are not responsible for third-party content, privacy practices, or terms.

10.2 Analytics and Tracking

We use third-party analytics services (e.g., Google Analytics) as described in our Privacy Policy.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms or use of Services shall be resolved in the courts of Sweden. You consent to exclusive jurisdiction in these courts.

11.3 Informal Resolution

Before initiating legal action, we encourage you to contact us at legal@passtrike.com to seek informal resolution.

11.4 EU Online Dispute Resolution

EU users may access the European Commission's Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

  • Deleting your account through account settings (when available)
  • Contacting support@passtrike.com
  • Following cancellation instructions in the app

12.2 Termination by Us

We may suspend or terminate your access immediately, without notice, if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account poses a security risk
  • You abuse or harass trainers or users

12.3 Effect of Termination

Upon termination:

  • Your right to access Services ends immediately
  • We may delete your account data (subject to legal retention requirements)
  • Provisions surviving termination: Sections 6, 8, 9, 11, and 12

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PASSTRIKE.

13.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

13.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

13.4 Assignment

You may not assign or transfer these Terms. We may assign our rights without restriction.

13.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, wars, pandemics, government actions).

13.6 Language

These Terms are provided in English. Translations may be provided for convenience, but the English version governs in case of conflict.
